Terms of service.
These Terms and Conditions ("Terms") govern the provision of plumbing and gas fitting services ("Services") by Jay Anthony Sweeney ABN 78 796 007 307, trading as J.A.S. Plumbing & Gasfitting ("Service Provider"), to the client ("Client"). By engaging our Services, the Client agrees to comply with these Terms. Please review them carefully, as they outline the rules and regulations applicable to our services. Your engagement with J.A.S. Plumbing signifies your acceptance of and agreement to these Terms.
2. Services -The Service Provider commits to delivering the Services as detailed in the service agreement or any other written communication between the parties. All Services will be professional and workmanlike, adhering to industry standards and applicable laws, including the Plumbing and Drainage Act 2011 (N.S.W.) and the Plumbing Code of Australia (P.C.A.). Our services encompass installations, repairs, maintenance, and emergency responses, all compliant with Australian standards and regulations.
3. Licenses and Compliance - The Service Provider holds all licenses and certifications required to perform plumbing and gas fitting work in New South Wales, as N.S.W. Fair Trading mandates. All work will comply with the Plumbing Code of Australia (P.C.A.) and relevant N.S.W. variations.
4. Quotations and Estimates - Quotations and estimates provided by the Service Provider are valid for 30 days from the date of issuance. The Service Provider reserves the right to revise quotations and estimates if the scope of work changes or unforeseen circumstances arise. Prices may vary based on scope, market conditions, and additional charges for services outside standard working hours or emergency callouts.
5. Payment Terms - Payment is due upon completion of the service unless otherwise agreed in writing. Accepted payment methods include cash, credit card, and electronic funds transfer. The Client agrees to: • Settle payment within Seven days of the invoice date. • Understand that late payments may incur interest at a monthly rate of 10%. • Acknowledge that the Service Provider reserves the right to suspend or terminate Services if payment is not received promptly. Additional charges and interest may apply to late payments.
6. Cancellation and Rescheduling- Appointments may be cancelled or rescheduled with at least 24 hours’ notice. Cancellations made within 24 hours of the appointment may incur a cancellation fee.
7. Client Responsibilities - The Client agrees to: • Provide clear access to the premises where Services are to be performed. • Ensure that all necessary permits and approvals are obtained before the commencement of Services. • Cooperate with the Service Provider and furnish any information reasonably necessary to facilitate the timely completion of Services.
8. Changes to Services- Any changes to the scope of Services must be agreed upon in writing by both parties. Additional charges may apply for changes resulting in increased costs or time required to complete the Services.
9. Warranties and Guarantees- The Service Provider warrants that Services will be executed in a professional and workmanlike manner. J.A.S. Plumbing offers a 7 year warranty on workmanship. Manufacturer warranties apply to all parts and materials used. We are not liable for any indirect or consequential damages resulting from our services
10. Retention of Title - All materials and parts supplied by J.A.S. Plumbing remain the property of J.A.S. Plumbing until full payment is received. In the event of non-payment, J.A.S. Plumbing reserves the right to reclaim any materials or parts, including those installed, to recover the outstanding debt. The Client agrees to grant access to the premises for this purpose if required.
11. Termination - J.A.S. Plumbing reserves the right to terminate service if the Client breaches any of these terms and conditions or engages in any unlawful or harmful conduct to our business. Upon termination, the Client shall pay the Service Provider for all Services rendered up to the termination date.
12. Subcontracting - J.A.S. Plumbing reserves the right to subcontract any part of the work to a qualified third party. All subcontractors are bound by the same terms and conditions.
13. Confidentiality - Any confidential information shared between J.A.S. Plumbing and the Client during the course of providing services will be kept confidential and not disclosed to any third party without prior consent.
14. Indemnification - The Client agrees to indemnify and hold J.A.S. Plumbing harmless from any claims, damages, or expenses arising from the Client’s breach of these terms and conditions or from client negligence.
15. Force Majeure - J.A.S. Plumbing is not liable for any failure to perform its obligations if such failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, or acts of war
16. Dispute Resolution - In the event of a dispute, both parties agree to attempt to resolve the issue through negotiation or mediation before pursuing legal action.
17.Governing Law - These Terms shall be governed by and construed in accordance with the laws of New South Wales, including the Plumbing and Drainage Act 2011 (N.S.W.) and any other relevant legislation.
18. Entire Agreement - These Terms and any service agreement or other written communication between the parties constitute the entire agreement and supersede all prior agreements, understandings, and representations.
19. Amendments - The Service Provider reserves the right to amend these Terms at any time. Any amendments will be communicated to the Client in writing and will take effect upon such communication.
